The Nebraska public records law has for many years included electronic records in its definition of public records. Neb.Rev.Stat. § 84-712.01(1) (Reissue 2008) (“Public records shall include all records of documents regardless of physical form. . . . Data which is a public record in its original form shall remain a public record when maintained in computer files.”).
The Nebraska Records Management Act requires each agency to submit a records retention and disposition schedule to the secretary of state; the agency may then dispose of record only in accordance with such approved schedule. Neb.Rev.Stat §84-1201, et seq.
