I. Economic development records.

Any files that might “give advantage to competitors or bidders” if disclosed and records maintained by the Arkansas Economic Development Commission that are “related to any business entity’s planning, site location, expansion, operations, or product development and marketing” are exempt from disclosure under the FOIA unless the business entity grants approval for release. Ark. Code Ann. § 25-19-105(b)(9)(A). The exemption does not apply to records of “expenditures or grants made or administered by the commission” that are otherwise disclosable. Id. § 25-19-105(b)(9)(B). The Attorney General has opined that local offices of Economic Development are not included by this exemption, though records maintained by those offices might be covered by the “competitive disadvantage” exemption in § 25-19-105(b)(9).
