As with other court records, appellate court records are also presumptively open. Barron v. Florida Freedom Newspapers, Inc., 531 So. 2d 113, 118 (Fla. 1988). Florida Rule of Judicial Administration 2.420 addresses public access to Florida court records and some provisions of the current rule could impact access to appellate court records. Effective October 1, 2010, Florida Rule of Judicial Administration 2.420(g) will address requests to determine the confidentiality of appellate court records in non-criminal cases.
