IV. "Reverse FOIA” Lawsuits"

When an agency releases information that the submitter of the information believes should have been withheld under Exemption 4, the submitter may bring a “reverse FOIA” suit against the agency under the Administrative Procedure Act to challenge its decision.¹⁰⁴
