Michigan Courts have not made distinctions on the basis of the news gatherer's status. The major appellate decision involved an international trade association of photo dealers and photofinishers which gathered data concerning the operations and activities of its members and published trade news periodicals. Although not a traditional news media, the court found sufficient facts to justify the possible application of a news writer's privilege and remanded the matter to the trial court to determine the applicability of a news writer's privilege to the respondent.
