Open Records I. STATUTE -- BASIC APPLICATION D. Fee provisions or practices. 4. Requirements or prohibitions regarding advance payment. Section 6253(b) of the CPRA provides that unless otherwise statutorily exempt, an agency shall make public records promptly available to any person "upon payment of fees" covering the direct costs of duplication. Thus, once an agency determines how many pages are requested to be copied, it calculates the total amount due and payment is to be made prior to actual receipt of the copies. Cal.
