NEW YORK– In early November, a federal District Court judge in New York City issued a preliminary injunction preventing the city government of New York from carrying the Fox News Channel on its public channels. Time Warner Cable had sued the city, which started showing the new Fox channel after the cable company decided not to include it in its service. Time Warner is the exclusive cable franchisee in New York City.

Judge Denise Cote wrote in her 106-page opinion that Mayor Rudolph Giuliani and his office violated “longstanding First Amendment principles that are the foundation of our democracy” by placing the Fox News Channel on a city-run channel reserved for public service and educational purposes. Cote had issued a temporary restraining order last month.
