EPA Ordered to Release Records on Mercury Regulation-Making

A federal magistrate ordered the US Environmental Protection Agency to release internal agency documents to Massachusetts Attorney General Thomas F. Reilly on its decision-making in the drafting of a controversial rule on regulation of mercury emissions from power plants. Reilly sued the EPA a year ago when EPA refused to release the records, claiming they were part of a “deliberative process” and thus exempt under the Freedom of Information Act. (4/14/06)
