A federal appellate court in Delaware ruled a key section of the state’s Free of Information Act is unconstitutional because it limits information access to state residents. “No state is an island,” Circuit Judge D. Brooks Smith wrote for the three-judge panel. The suit challenging the provision in the Delaware law was filed by a consumer advocate from New York. (8/17/06)
