Court Faults NY State Police for Records Withholding in Brutality Case

Acting New York Supreme Court Judge Thomas McNamara faulted state police for engaging in a “cat and mouse” game over release of public records in a police brutality case. He said the agency had no legitimate to redact the information it did. Police said release would invade the privacy of witnesses but the judge said police offered “no factual basis” to show the witnesses expected their identities would be shielded “or that some identifiable harm would result from release of that information,” (8/20/07)
