An Affair to be Remembered: The E-mails Are Public Record

A circuit judge in Kentucky ruled that the e-mails exchanged by two state employees were public record and, as a result, the husband of one of the workers could have access to the messages to see if he wife was having an affair.    The state argued the e-mails were exempt  for several reasons, including personal privacy.   “The fact that state employees are using state resources to exchange non-work-related messages during working hours is a matter of legitimate inquiry for the public,” said Judge Phillip J.
