A Texas appeals court ruled in a suit brought by the Dallas Morning News that state employees’ birth dates are public and must be released. The court said the state controller’s office hadn’t proved its claim that release of the information posed identity theft problems. “The speculative and unproven threat of identity theft is insufficient to exempt date-of-birth information from disclosure,” the court said.
