ABA Urges Review of " Sensitive But Unclassified" Policy

The American Bar Association called on Attorney General Alberto Gonzalez to make clear that the designation of a record as “sensitive but unclassified” does not provide agencies a legal basis for withholding the record from release under FOIA. There now more than 55 separate SBU designations – each with its own definition – being used to safeguard information. President Bush has called for government-wide standardization but his directive does not deal with the issue of information withholding. (2/18/06)
