In a decision recently unsealed, the D.C. Court of Appeals has ruled that a case can go forward despite the government’s claim of state secrets privilege. The court didn’t rule on the merits of the secrets claim, but rather said that former DEA official Richard Horn had sufficient evidence without tapping any secrets to bring the case to court. Horn claims the CIA and State Department eavesdropped on his communications while he was stationed in Rangoon. (8/17/07)
