The U.S. Fourth Circuit Court of Appeals ruled that the CIA’s “state secrets” claim prevented the federal courts from considering the claim of a German citizen that he was kidnapped and tortured by the agency. Despite holding that the CIA’s assertion blocked court action, the judges insisted that “the state secrets doctrine does not represent a surrender of judicial control over access to the courts.” (3/5/07)
