Reporters Committee attorneys filed an amicus brief in Ohio A. Philip Randolph Institute v. Obhof, a partisan gerrymandering case in the U.S. Court of Appeals for the Sixth Circuit. The case presents right-of-access issues related to court documents. The lower court ordered the Republican National Committee, the National Republican Congressional Committee, and their former redistricting coordinator Adam Kincaid to disclose certain documents and submit to a deposition. Those materials, which were not filed pursuant to a protective order or under seal, were later used at trial and referenced in the court’s opinion. On appeal, the RNC, NRCC, and Kincaid seek to reverse the lower court’s orders compelling disclosure. The amicus brief argues that the First Amendment right of access attached to the portion of the documents used at the public trial.
