A divided appeals court on Friday let stand a prior ruling, which prevents the government from limiting what information judges hear in the trials of detainees being held at Guantanamo Bay, Cuba.

The administration plans to file an emergency appeal to the U.S. Supreme Court by Feb. 14. The Bush administration argues that national security concerns give them the power to determine what documents are relevant for judicial review.

This decision may have bearing on a related case, Boumediene v. Bush, which addresses a court’s jurisdiction to hear habeas corpus petitions from detainees who dispute their confinement.
