Arkansas’ Supreme Court ruled the city council in Fort Smith met illegally in private in approving a 2002 property deal. The city manager had separate individual conversations, in person or by phone, with members of the city board of directors leading up to the contract. The court said that the state’s Freedom of Information Act “may not be circumvented by delegation of duties to others.” (11-5-04)
