Court Wonders, Can Prosecutors Classify What Happens in Court?

A federal appeals court in San Diego said it wanted to hear more arguments from prosecutors before with a hearing involving a key figure in the case of former congressman Randy “Duke” Cunningham. The issue: Can members of the executive branch of government – the prosecutors – declare records generated by the judicial branch “classified.” Prosecutors want the hearing closed and records sealed, contending that all or some of the transcripts from the closed Cunningham hearings in February are classified.
