Responding to what it referred to as “significant adverse comment,” the Food and Drug Administration withdrew a direct final rule published last fall that incorporated three FOIA exemptions into its public information regulations. The three are exemptions for national security, internal personnel rules and practices, and statutory mandate. None of the three exemptions had previously been considered by the agency when reviewing FOIA requests. (1/18/05)
