Judge Strikes Part of Executive Order on Presidential Records

A federal judge held invalid part of President Bush’s 2001 executive order giving former presidents and vice presidents the right to review executive records before they are made public under the Freedom of Information Act. U.S. District Court Judge Colleen Kollar-Kotelly said the portion that blocks public access to the records while they are being reviewed by a former president violated the Presidential Records Act and represented an unjustified expansion of executive discretion.
