A judge in Harrison County, Mississippi, that the videotape of the beating of a jail inmate was a public record. The beating victim died two days later. However Chancery Judge Jim Persons said he cannot order release of the materials because the records are now in federal custody. He said the Biloxi Sun Herald will have to go to federal court.
