A New York appeals court said that a government agency that cites privacy in withholding records has the burden of proving release of the information would create an “unwarranted invasion of personal privacy.” The case, involving Suffolk County’s refusal to provide records sought by a commercial provider of land records, Data Tree LLC, will be sent back to the lower court.
