The Department of Homeland Security implemented final regulations on Chemical Plant Security, modifying the department’s broad preemption of state law but doing little to assuage concerns of open government advocates on the lack of public accountability and access to information. The final regulations create a new category of sensitive but unclassified information called Chemical-terrorism Security and Vulnerability Information (CVI), which DHS will treat as exempt from disclosure under the Freedom of Information Act.
