Sens. Edward Kennedy, D-MA, and Arlen Specter, R-PA, introduced a new bill (S 2533) intended to protect legitimate secrets while allowing litigation is proceed against a “state secrets” claim. The “state secrets” claim has been invoked by the government recently in an effort to halt cases involving domestic surveillance and prisoner torture. They said the bill provides for an in camera test of the validity of the government’s claim. (1/24/08)
