Transportation Secretary Norman Mineta issued a directive formally delegating authority to designate what is Sensitive Security information to the Department of Transportation’s general counsel, the director of intelligence and security, and all other administrators in the department – and their designees. The transportation-related information they decide to mark SSI will be withheld from the public under the Freedom of Information Act, and may be withheld from any public rulemaking record and from discovery in civil litigation. Separate regulations give concurrent authority to denominate SSI to the director of the Transportation Security Administration and whomever he designates. (1/18/05)
