"State Secrets" Cases on Surveillance Get an Appellate Review

An federal appellate court is hearing two lawsuits, one alleging AT&T illegally collaborated with the National Security Agency in its terrorist surveillance program, and the other arguing the government illegally spied on two attorneys for a Saudi charity. In both, the government is claiming a “state secrets” privilege to support its refusal to provide information to the litigants and avoid shedding any light on its electronic surveillance program.
