A federal judge dismissed in part a lawsuit brought by the New York Times seeking documents on the government’s warrantless surveillance program from the departments of Justice and Defense. Judge Richard M. Berman said the information he reviewed was properly classified and not subject to disclosure under the Freedom of Information Act, however he said he would make a second decision after reviewing unclassified information covered in the Times request.
