The Ohio State Supreme Court ruling that the Miami University of Ohio school newspaper is entitled to student disciplinary records will stand, after the U.S. Supreme Court announced in early December that it will not accept the university’s appeal.

The university claimed that complying with the state court’s order to release the records could jeopardize its ability to collect federal funds under the Buckley Amendment, which prohibits the release of federal funds to schools which improperly disclose “education records.” However, the Ohio high court ruled in July that disciplinary records are not “education records.”
