U.S. Argues Plaintiffs Should "Bear State Secrets Burden"

A Bush Administration lawyer raised the “state secrets” privilege in urging a federal judge to dismiss a suit filed by five men against a San Francisco flight planning company they claim aided the CIA in transporting them to overseas torture chambers. The plaintiff’s allegations can only be proved by presenting classified information to the court, a Justice Department attorney in urging the case be dismissed and that the plaintiffs “bear the burden on behalf of society.” (2/6/08)
