The Bush Administration has indicated that it will again try to use the “state secrets” privilege to block litigation, this time a suit subpoenaing of banking records from Swift, the Belgian banking cooperative. The administration has now used the privilege claim more than 30 times in terrorism-related cases, including suits involving the National Security Agency’s electronic surveillance program. (8/31/07)
