Judge Declares NSA Surveillance Unconstitutional, Orders Immediate Halt

A federal district court held that the NSA’s warrantless surveillance program violates the First and Fourth Amendments and ordered it ended immediately.. District Judge Anna Diggs Taylor granted a motion by the plaintiffs, the American Civil Liberties Union, for a permanent injunction, holding their claim was not barred by the states secrets privilege because it could be based on the government’s public statements about the program. She went on to say that “The president of the United States … has undisputedly violated the Fourth in failing to procure judicial orders.” (8/17/06)
